Viscount Camrose, Parliamentary Under Secretary of State (DSIT, https://lnkd.in/eMj4gfDg) predicts three things in relation to any solution dealing with IPRs and artificial intelligence: "Perhaps my noble friend will forgive me if I gaze into a crystal ball for a moment and predict that the eventual solution to this will involve three elements: first, some modifications to our copyright legislation; secondly, some use of technology to enable a solution; and thirdly, internationally accepted standards of interoperability in any eventual solution." Today China SPC published a very interesting case (original Chinese press release here: https://lnkd.in/gdU3uCKc and an AI translation of the full decision is attached). It's the first IP sanction the SPC issued this year against an accused software copyright infringer for contempt. More specifically, this defendant refused to cooperate during the trial court's evidence preservation (civil seizure) in their office by intentionally deleting the unauthorized software (evidence destruction). The SPC imposed a fine of RMB 1M (around $150K) on this company. This is a very encouraging example where Chinese courts are taking evidence preservation more seriously so it can drive more meaningful discovery in legal proceedings in China. Bad faith contempt will be punished as such (in addition to likely losing the case too) so infringers will need to reconsider if they would destroy or hide evidence. #chinaip

It will be really interesting to see how this plays out. The Wu-Tang Clan album “Once Upon a Time in Shaolin” only has the one physical copy made in 2015. According to the article, as per the purchase agreement, it cannot be uploaded for online listening and no physical copies can be made until the year 2103. Some interesting issues arise: - It’s unclear whether the article is discussing ownership over the copyright or the physical album. I believe it’s the latter and either way, it looks like Shkrelli didn’t own either at the time of the alleged infringement. - Because it’s a single physical album, does the first sale doctrine apply and, therefore, does contract law dictate how the copy can be used? - What role does the Right of Termination play here? Would the Wu-Tang Clan be able to reclaim their right to the album in the year 2040-2045 and release it however they like? Or is it a work made for hire? One thing is for sure, he violated the copyright by both making copies of the album and by publicly performing it, which, in the online format, is effectively making copies again. https://lnkd.in/eTNzwGbM
